Peter Beal Losing His Home and Workshop
Reading Geoff Larcom’s article in the Sunday, 4/15/07 issue of the Ann Arbor News, I was
particularly saddened to read that Peter Beal is about to lose his home and workshop, all for
a $2,104 property tax bill dating back to 1995. According to the article, an out-of-state firm
has claimed title to his property, which is worth much more than the taxes paid by this
company.
According to the article, Mr. Beal has lived their since 1978, he is a woodcraft artist and has
made many projects that are around our town. This whole process seems very predatory, it
is a real tragedy, and most of us would consider it a real injustice for the courts to enforce this
takeover. It certainly does not seem fair.
All I can do is write a letter to you. I feel quite helpless, but it would be very nice if someone in
our community could help this man who has given so much to us.

Beal's loss has become community's loss, too
It was with deep sadness I read the April 15 article about Peter Beal losing his
farmhouse and workshop/barn. I have watched these structures evolve over the last
30 years from drab to charming. The chickens scratching in the farmyard have long
provided a pleasant and blood pressure-lowering incongruity to their urban and
commercial surroundings - a nostalgic reminder of another place and time. I have
visited the workshop a time or two.
Peter, a hard-working artist whose medium happens to be wood, works with a
symphony or opera competing with the noise of his power tools; lines of poems or
quotes are tacked askew to the wall along with orders and specs. He's no ordinary
guy ... just a poor bookkeeper.
The officials at Destiny 98, which purchased a '95 tax lien on Peter's property for
$2,104 and is forcing him to leave, say they're not villains. Please prove it. Prove you
don't exploit the misfortunes of others. Alter your protocol to include an act of
human kindness that puts decency above profit. But then, that might call for quiet
character and nobility. Money shouts.

Can Peter Beal's home be saved for him?
Regarding the April 15 article in The Ann Arbor News about Peter Beal and how he
will be losing his home and workshop because of a policy which was clearly
unfair and has since been rescinded. Catherine McClary, Washtenaw County
treasurer, is quoted as saying: "He was burned by a bad system.'' As I understand
it, this system allowed outside interests to quietly buy up unpaid taxes sold by the
county and, by doing so, obtain title to properties.
Peter is known as an upstanding citizen and as a patient woodworking instructor
at Washtenaw Community College. He has very high standards and holds his
students to those standards.
There are many people in the community who want very much to help, but the
question is "How?'' Would the Michigan Tax Tribunal deal with this? I know of a
situation where a landowner was, for several years, taxed for 600 feet of lake
frontage when the 600 feet were actually in the water! A hearing was held at the
county level and the request to reassess was denied. However, an appeal to the
Tax Tribunal brought an understanding of the problem and help in the form of
reassessment and restitution for the overpayment of several years' duration.
Is there any chance that the new owner would return the property if he were paid
for his out-of-pocket costs plus interest? I am confident that there would be many
in our community who would offer financial support if a reasonable settlement
could be reached.

Mr. Beal,
I'm very sorry to hear about your property. My children and I wondered what
happened to the chickens, if I'm getting the location correct. It was a sudden
change. I had no idea what to think. For years, I had hoped we would get a
red light on Scio Church before turning left to go to the library, etc, so that we
could watch the chickens.
I hope it will go well for you. Try fund-raising if nothing else works!! People
will surely support you.

go past your house. I loved seeing the chickens randomly running around!

I'm sorry you have lost your home and property. It seems to me that
you were pretty reckless with your finances and now you are
confronted with the consequences of your fiscal irresponsibility.
Instead of publicly whining and lobbying for someone to bail you
out, pick yourself up and get on with your life. Millions of others
with less wherewithal than you have done it. So can you.

David,
I can understand how you got your impression of me, but the immediate
response I received from the Observer article was from friends and
supporters reassuring me that " it wasn't that bad..." and "people who
know you, know better (etc)." The jumbled history of my finances, although
essentially correct in many ways, was hopelessly disorganized and implied
connections that did not exist. It also failed to make clear an actual key
unifying incident whose significance Jim Leonard failed to grasp.
Your e-mail is the first, and only, negative response.
I am NOT whining for someone to bail me out. And you're right, I do have
the means to take care of myself and I am doing so. What I am continuing
to rail against is the obscene manner - much of which hasn't been
publicized - in which Destiny-98 has pursued their goals: they have no
constructive concrete plans for 1960 except to turn a profit, they have no
capacity to do better with it than I, and the geo-political realities that
surround 1960 are such that, no matter what blather Doug Gale puts forth, I
was, in actual fact, making the best use possible with the property. All
Destiny-98 will do is spoil what I and others started, and turn a working
enterprise and home into an unbuildable, empty lot.
I am, and have always been, prepared and able to pay Destiny-98 a fair
market price to buy back 1960, but, although they have not outright
refused to deal with me, they have made any negotiation impossible to
start since Mr Gale refuses to acknowledge the realities of the property's
worth. He simply doesn't respond to fact-based challenges to his inflated
view of it's value. Currently he has it listed for sale at $200K as a prime
location lot, implying that it is suitable for development in the near future,
a characterization that my advising realtors - in fact ALL local realtors I've
spoken to who are familiar with the details, except possibly Mike
Thompson - find ridiculous. Listing:

Sir, while I feel for you in the loss of your home and the ordeal you have gone
through- you have had 12 years to rectify that missed year of taxes. 12 Years. There
are tons of resources out there for people who are behind in their taxes. This
entire site and campaign of yours seems to be a last ditch effort that could have
been prevented countless times in the past 12 years by taking a personal
responsibility for the fact YOU didn't pay your taxes. I personally am terrible at
paying bills and taxes, and when the repercussions occur, I do what needs to be
done to rectify this shortcoming in myself and keep what is mine. Stop playing the
victim and admit that you got yourself and your family into this situation. The long
and short of it is, no matter how despicable the company buying your property from
the state may be - if even five years after those taxes were due you had paid them
and the penalties, this wouldn't have occurred to you. How long do you expect a
state in such desperate need of funds to let a past due bill slide? 20 years? 50?

I'm sorry it has taken me so long to get back to you. Having to move, set up a
new temporary shop, keep up as best possible with my commission work and
carry forward a full-time teaching position, while trying to buy back 1960,
keeps me busy...
There was no fraud involved. Except for one aspect, Destiny-98 seems to
have done everything they were required to under the old Michigan property
tax lien legislation. But that exception was unsupported by adequate case law
and open to interpretation, allowing the initial judgment, by an elected judge
with limited legal background, going against me. The Court of Appeals chose
to affirm Judge Sheldon's ruling, rather that prolong a case based on no
longer operating law. I interpret the Supreme Court's declining the case
similarly.
My complaint hasn't been against the laws involved or even against
Destiny-98 "doing their thing", but the fact that their MO and lack of expertise
in local real estate markets doesn't allow them to assess a property to
discover it's true value without displacing the owner, at which point any
damage has been done. This is what I've refered to often as the "obscene"
part of what's happened.
Thanks for your thoughts and advice and I really wish it had been something I
could have worked with.
I'm revising the website and will add your e-mail to the others we've recieved.
I hope to have an extensive revision ready in the nest few weeks.

Thank you for your remarks and observations. I will, and have, taken them
to heart.
As a point of fact, you aren't quite right that I had 12 years to pay the
taxes. Once Douglas Q Gale of REO America/Destiny-98 TD decided to
foreclose in '04, they showed no interest in being paid for the taxes, even
with interest, fees and generous additional money for their time and
effort. This takes off 3 years from your accounting.
That does leave 9 years I had to pay the '95 taxes, the only year's taxes
out of 29+ that I had failed to cover. But turn the issue around and ask
yourself, does it make sense or seem fair to lose one's home and
livelihood for less than $5000 to a private company that rejects
reasonable offers to buy back the property, only because they apparently
lack the competence to realize that they are demanding far more than
local real estate conditions will allow?
Also, I'm think you've misunderstood me if it has come across to you that I
feel I am a victim of the tax system. Although no such system, and others
modeled like it, can be perfect, I've never felt it was unfair in it's
intentions, but only that it induces the unintended consequence of
encouraging involvement by this type of predatory "investor".
What I am a victim of is the stupidity of, as you put it, the "dispicable
company" that purchased the tax deed/lien on a piece of property even
the most cursory research would have revealed to have no undeveloped
equity beyond it's mere market value, which is slight. Setting aside simple
ineptness, this leaves the following as the only interpretation of the
company's motivation in foreclosing: that it put them in a better position
to extort a higher price from me if I were foolish enough to believe their
evaluation of it's worth...

has the moral conviction to do what's right. Hopefully it will.

Mr. Douglas Q. Gayle,
I am writing to you on behalf of Mr. Peter Beal. Please read my letter enclosed as it is just a snapshot of
the kind of person he is with the hopes of you working out a mutually acceptable agreement with Mr. Beal.
As a Vietnam era Army veteran and recently medically retired manager from General Motors due to the
negligence of a Semi-Truck driver who decided not to stop at a traffic jam and rear ended my vehicle on
I96WB. Suffering broken vertebrae in my back and neck, crushed ribs, traumatic brain and internal
injuries, I have gone through extensive physical and therapeutic therapy during my arduous road to
recovery.
None of this has been so helpful or encouraging as has been learning cabinetry and furniture making
under the tutelage of Mr. Peter Beal. While I can no longer do or learn things like I used to, Mr. Beal has
taken the time to show me other ways and methods which yield the same results.
My story is not unique. Mr. Beal treats all his students with such class. He devotes so much time and
energy into ensuring that everyone learns to their utmost potential. I am not looking for pity as I consider
myself lucky to still be here and contributing. What I am looking for is compassion by you in that you work
something out with Mr. Beal that would allow him to continue to own his shop where he's worked at and
called home for over thirty years.
It would be a huge loss for the community as well as those of us who learn from him. I can't begin to
express my thanks to him for helping me overcome my limitations and feel positive about the future.
In conclusion, I hope I reached you in that you not take the property. You might even feel good by doing
a good deed for Mr. Beal just as he's done for countless others. Please work something out with him that
will benefit both of you.
